Terms of Service

These Terms of Service apply when you use benmos.shop or buy from Benmos ("Benmos", "we", "us"). By using the site or placing an order, you agree to them. If you do not agree, please do not use the site.

Who can order

You must be at least 18 years old, or the age of majority where you live, to place an order. You agree that the information you give us at checkout is accurate and that you are authorized to use the payment method.

Orders

Placing an order is an offer to buy. The order confirmation email shows that we received your order; we accept the offer when we ship it. We may decline or cancel an order, for example if an item is unavailable, the price or description was wrong, or we suspect fraud. If we cancel an order you have paid for, we refund it in full.

We sell to people buying for their own use. We may limit quantities or decline orders that appear to be placed for resale.

Prices and payment

Prices are in US dollars and do not include sales tax, which is shown at checkout where it applies. We may change prices at any time, but a change does not affect an order we have already accepted. Payment is taken when you place your order. If a product is listed at the wrong price by mistake, we will contact you, and you can pay the correct price or cancel for a full refund. Product information

We work to describe products accurately, including specifications supplied by manufacturers. Colors can look different from screen to screen, and manufacturers may change specifications without notice. If a product is not as described, you can return it under our Returns & Refunds Policy.

Shipping, delivery and risk of loss

Shipping is described in our Shipping Policy, which is part of these terms. Ownership of the product and the risk of loss pass to you when the order is delivered to your address.

Warranty

Products are covered by the manufacturer's warranty as described on our Warranty page. Except for that warranty and any rights the law does not allow us to exclude, the site and products are provided "as is", and we disclaim implied warranties, including merchantability and fitness for a particular purpose, to the extent the law permits.

Limitation of liability

To the extent the law permits, Benmos is not liable for indirect, incidental, special or consequential damages, and our total liability for any claim about a product is limited to the amount you paid for it. Some states do not allow these limits, so they may not apply to you. Nothing in these terms limits liability that cannot be limited by law.

Using the site

You agree not to misuse the site. In particular, you agree not to:

Use the site for anything unlawful or fraudulent
Interfere with the site's operation or security, or try to access areas you are not authorized to use
Copy, scrape or collect site content or data by automated means without our written permission

Intellectual property

Site content, including text, images and logos, belongs to Benmos or its licensors and may not be reused without permission. Brand and product names belong to their owners and are used to identify the products we sell.

If you believe content on the site infringes your copyright, email support@benmos.shop with the content's location, proof of your ownership and your contact details, and we will review it promptly.

Reviews and messages

If you send us a review, a comment or a suggestion, you give us permission to use it on the site and in our marketing without payment. Do not submit anything unlawful, misleading or that belongs to someone else.

Links to other sites

The site may link to websites we do not control. We are not responsible for their content or practices.

Electronic communications

When you place an order or contact us, you agree that we may send you notices about your order by email. Privacy is covered in our Privacy Policy.

Events outside our control

We are not liable for a delay or failure caused by events we cannot reasonably control, such as severe weather, carrier disruption or supply shortages. If such an event prevents us from fulfilling your order, you can cancel it for a full refund.

Disputes

If you have a complaint, please contact us first at support@benmos.shop. Most problems are resolved quickly this way, and we will work with you in good faith for 30 days before either of us goes to court.

Governing law

These terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law rules. Disputes will be brought in the state or federal courts located in Oregon, unless the law of your home state gives you the right to bring a claim there.

General

If a court finds part of these terms unenforceable, the rest stays in effect. If we do not enforce a term, that is not a waiver of it. These terms, with the policies they link to, are the whole agreement between you and Benmos about your use of the site and your orders.
